Responsible Use

This Responsible Use Policy (“RUP”) supplements and forms part of the Terms of Service or any other agreement or order form between Eigenplex (“we,” “us,” or “our”) and you, the customer or user (“you”), governing your use of the Eigenplex Platform, website, Generated Output, and related services (collectively, the “Agreement”). This RUP applies to your access and use of the Platform, including all Customer Data (such as Input Data you provide and the Generated Output produced). Capitalized terms not defined here have the meanings given in your applicable Agreement with Eigenplex.

You agree not to provide any Input Data to the Platform, nor to knowingly use the Platform to generate, use, or distribute any Generated Output, for any of the following prohibited purposes:

1. Violating any applicable national, federal, state, local, or international law or regulation.
2. Generating or distributing spam in violation of laws such as the CAN-SPAM Act of 2003.
3. Exploiting, harming, or attempting to exploit or harm minors in any way.
4. Creating, processing, or disseminating pornographic, sexually explicit, or adult content.
5. Generating or disseminating verifiably false, misleading, or deceptive information (including in fields such as medicine, health, and science).
6. Generating or disseminating personally identifiable information intended or likely to harm an individual.
7. Generating or disseminating content (e.g., images, code, articles) without clearly and intelligibly disclosing that it is machine-generated, especially when placed in a public context.
8. Defaming, disparaging, cyber-bullying, or harassing others, or encouraging self-harm or harm to others.
9. Impersonating or attempting to impersonate others (e.g., creating deepfakes) without their consent.
10. Engaging in fully automated decision-making that adversely impacts an individual’s legal rights or creates/modifies a binding obligation.
11. Discriminating against or harming individuals or groups based on behavior, personal characteristics, or in a manner that is obscene, violent, hateful, racist, or otherwise offensive.
12. Exploiting the vulnerabilities of a group based on age or physical, social, or mental characteristics to materially distort behavior in a way likely to cause physical or psychological harm.
13. Discriminating against individuals or groups based on legally protected characteristics or categories.
14. Conducting political lobbying or campaigns to influence government officials, legislators, or agencies on legislative, regulatory, or policy matters.
15. Providing medical advice, interpreting medical results, or promoting pharmaceuticals/medical services without the required legal qualifications, licenses, or permits.
16. Engaging in or promoting regulated services/professions (e.g., legal, accounting, investment advice, insurance, banking) without the required legal qualifications, licenses, or permits.
17. Generating information for use in justice administration, law enforcement, or immigration/asylum processes to predict an individual’s likelihood of committing fraud or a crime through prohibited profiling methods.
18. Infringing, violating, or misappropriating the intellectual property or proprietary rights of any person.
19. Transmitting or making available any malicious code (e.g., viruses, worms, spyware).
20. Circumventing technical or other safeguards implemented by Eigenplex or its third-party service providers to ensure compliance with this RUP and equivalent policies.

If you become aware that the Platform or Generated Output has produced content falling into any of the above categories, you must notify us in writing without undue delay.

Enforcement of this RUP, including determining violations and their severity, is at Eigenplex’s sole discretion. Our failure to enforce a provision in one instance does not waive our right to enforce it in others.

Upon violation, you must promptly cease using any non-compliant Customer Data, Input Data, or Generated Output. Eigenplex reserves the right to promptly remove or delete such data, remove violating Generated Output, or modify the Platform to ensure compliance with this RUP and applicable law.
